Terms of Service

Agreement

These terms govern your use of CoachLoop: the mobile app for iOS and Android and the web pages at coachloop.online. CoachLoop is operated by Newco Sports and Talent Group, LLC (“CoachLoop”, “we”, “us”). By creating an account or using CoachLoop, you agree to these terms and to our Privacy Policy. The app asks you to confirm this by tapping “I agree” before you can use it, and asks again when these terms change in a way that needs your agreement.

Who can use CoachLoop

  • You must be at least 13 years old.
  • If you are 13 to 17, you can use CoachLoop only with a parent or guardian. Your player profile stays pending until a guardian is linked to it. The guardian agrees to these terms for you as well as for themselves and is responsible for your use of CoachLoop.
  • Coach accounts are for adults.
  • CoachLoop is offered in the United States only, and only coaches based in the United States can take payments through it.

Your account

Give accurate information, keep your password private, and tell us at hello@coachloop.online if you think someone else is using your account. You are responsible for what happens under your account. One account can belong to several coaching organizations, with a separate role in each.

How CoachLoop works

CoachLoop is software that coaches use to run a coaching organization: sharing practice plans and drills, reviewing swing videos, scheduling lessons, messaging players, and taking monthly subscription payments. Coaching advice comes from the coaches, not from CoachLoop. Coaches are independent businesses, not employees or agents of CoachLoop, and the coaching itself is an arrangement between the coach and the player. CoachLoop provides the platform and does not supervise or guarantee any coach’s services.

Sports practice involves physical activity and some risk of injury. Use your own judgment, and talk to a medical professional if you have a health concern. CoachLoop does not give medical advice.

Your content

You keep ownership of what you add to CoachLoop, such as swing videos, narration, drawings, comments, drills, messages and journal entries. You give CoachLoop a non-exclusive, royalty-free license to store, copy, process (for example, convert videos and produce finished review videos) and display that content to the people you share it with, for as long as it is on CoachLoop and only to provide, secure and improve the service. Improving the service means fixing problems and making features work better; we do not sell your content, use it for advertising, or make it public. The exception is what a coach chooses to publish on their organization’s public page, such as program and drill titles and cover images.

Only add content you have the right to share. If a video shows another person, you need their permission, or their guardian’s permission if they are under 18.

Community standards

CoachLoop is a private space for coaches, players and their families, and many players are minors. We have zero tolerance for objectionable content and abusive users. This applies to everything you share: messages, announcements, videos, narration, drawings, comments and profile details. You agree not to:

  • harass, bully, threaten, intimidate or exploit anyone, especially minors;
  • post hate speech, or content that demeans people for their race, ethnicity, religion, gender, sexual orientation, disability or any other protected characteristic;
  • post sexual or sexually suggestive content, or any content that sexualizes a minor;
  • post violent, graphic or self-harm content, or encourage anyone to harm themselves;
  • upload content that is illegal, that you do not have the rights to, or that shows another person without their permission (or their guardian’s, if they are under 18);
  • ask a player who is a minor to move a conversation off CoachLoop, or for private contact details, without their guardian’s knowledge;
  • impersonate anyone, or misrepresent who you are or your coaching credentials;
  • access another person’s account or data without permission;
  • probe, overload or interfere with the service, or get around its limits or security controls;
  • use CoachLoop to send spam or to resell the service without our written consent.

Reporting, blocking and enforcement

  • Report. In any conversation you can report a message or the whole conversation. Reports go to our support team with a copy of the reported content. You can also write to us at hello@coachloop.online.
  • Block. You can block anyone you message with. While a conversation is blocked, neither person can send messages in it, and a player who blocks their coach also stops receiving that coach’s announcements. Blocking does not end the coaching relationship; reviews, plans and lessons continue.
  • What we do. We review reports within 24 hours. If content or behavior breaks these terms, we may remove the content, suspend or remove the user from an organization, or close their account, with or without notice. We report apparent child sexual exploitation to the National Center for Missing & Exploited Children as the law requires, and may report other content to the authorities when a person may be at risk. If you think we got a decision wrong, write to hello@coachloop.online and we will look at it again.

Subscriptions for players

Paid subscriptions are not available in the app yet. Until a coach offers one there, nothing is charged; when they do, these terms apply.

  • What you pay for. A coach can offer a monthly training subscription and optional monthly add-ons. The training subscription unlocks the player’s access with that coach; add-ons do not unlock access on their own. A coach may offer a free trial of up to 30 days on the training subscription; unless you cancel before it ends, the trial turns into a paid subscription.
  • Who you pay. You buy the subscription from the coach. Payments are processed by Stripe on the coach’s own Stripe account, and your card statement shows the coach’s business name. The price you see is the full monthly price: it includes CoachLoop’s service fee and the cost of processing your payment. Prices are in US dollars.
  • Renewal. Subscriptions renew each month and are charged automatically until you cancel.
  • Cancelling. You can cancel in the app at any time. Cancellation takes effect at the end of the current billing period, and you keep access until then. You can undo a cancellation before the period ends.
  • Price changes. A coach can change their price for new players only, or for existing players from their next renewal. If your price changes, the new price applies from your next renewal and is shown on your membership screen in the app. You can cancel at any time.
  • Failed payments. If a renewal payment fails, you keep access for 7 days while the payment is retried. After that, access may end.
  • Refunds and disputes. Payments are not refunded for partly used months, except where the law requires it. Ask your coach about a refund; refunds are at the coach’s discretion and are made by the coach. While a card dispute is open, access to the subscription is paused, and it is restored if the dispute is resolved in the coach’s favor.
  • Lessons. Coaches may list lesson prices in CoachLoop, but lessons are not charged through CoachLoop. Arrange lesson payment with your coach.

Terms for coaches

These payment terms apply once charging players is available in the app.

  • Your Stripe account. To charge players, a coach opens a Stripe account through Stripe’s onboarding and agrees to Stripe’s services agreement. Only US accounts are supported. You are the seller of your coaching subscriptions: charges are made on your Stripe account, and Stripe’s processing fees, refunds, disputes and chargebacks are yours, under your agreement with Stripe.
  • CoachLoop’s fee. For each player each month, CoachLoop’s fee is the first $5 of your price for that player (training subscription and add-ons combined), plus half of the part of your price between $5 and $50. There is no fee on the part above $50. For example, on a $20 monthly price, CoachLoop’s fee is $12.50 and you keep $7.50. The price players pay is your price plus an amount that covers Stripe’s typical processing cost, so your share is not reduced by it on a standard US card. CoachLoop’s fee is collected from each payment through Stripe.
  • Payouts. Stripe pays your share out to your bank on your Stripe account’s payout schedule.
  • Refunds and disputes. You handle refund requests from your players and decide whether to refund. A refund or a lost dispute comes out of your Stripe balance. CoachLoop’s fee is not refunded.
  • Your responsibilities. Coaches are responsible for their coaching, for the accuracy of their prices and public page, for approving the players and staff in their organization, and for following the law when working with minors, including any background check, license or certification the law or a governing body requires. You are responsible for your own taxes on what you earn, including any sales tax on your services. Stripe may send you a tax form for payments made to your account.

Ending your use

You can stop using CoachLoop and ask us to delete your account at any time. See how to delete your account. We complete a deletion request within 30 days; the Privacy Policy explains what is deleted and what is kept. Before an account is deleted, any subscription it pays for is cancelled. The only owner of a coaching organization must add another owner, or ask us to close the organization, before their account can be deleted.

We may suspend or close an account, or remove someone from an organization, if they break these terms, put other users at risk, misuse payments, or if the law requires it. Where it is safe and lawful, we will tell you why and give you a chance to respond. Sections that by their nature should continue, such as those on content, liability and disputes, continue after your use ends.

Other services

CoachLoop relies on other companies, including Apple, Google, and Stripe. When you use their services through CoachLoop, for example to download the app or to pay, you must also follow their terms.

We give you a personal, non-exclusive, non-transferable, revocable license to use the CoachLoop app on devices you own or control, as these terms and, for App Store downloads, Apple’s Usage Rules allow.

If you downloaded the app from the Apple App Store: these terms are between you and CoachLoop, not Apple, and CoachLoop, not Apple, is responsible for the app and its content. CoachLoop alone is responsible for maintaining and supporting the app; Apple has no obligation to provide maintenance or support for it. If the app fails to meet a warranty that applies to it, you may tell Apple, and Apple will refund any purchase price you paid for the app; Apple has no other warranty obligation. Apple is not responsible for claims about the app, including product liability claims, claims that it fails to meet a legal or regulatory requirement, claims under consumer protection, privacy or similar laws, or claims that it infringes someone’s intellectual property; CoachLoop is responsible for handling those. You confirm that you are not in a country subject to a US embargo or on a US list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

Disclaimers and limits of liability

CoachLoop is provided as it is and as available. We work to keep it running and to protect your content, but we cannot promise it will always be available or free of errors. To the extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement.

To the extent the law allows, CoachLoop is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, and our total liability for any claim about CoachLoop is limited to the greater of the fees CoachLoop received from your payments in the 12 months before the claim or $100. Some places do not allow these limits, so they may not apply to you.

You agree to cover CoachLoop’s losses and reasonable costs from claims by others that arise from content you share, your coaching (if you are a coach), or your breaking these terms.

Governing law and disputes

These terms are governed by the laws of the State of Arizona, without regard to its conflict of law rules. Before bringing a claim, please write to hello@coachloop.online so we can try to resolve it; most concerns can be settled that way. Any claim that is not resolved will be brought in the state or federal courts located in Maricopa County, Arizona, and you and CoachLoop agree to their jurisdiction. Either of us may bring a qualifying claim in small claims court instead.

Changes to these terms

We will post any change on this page and update the date at the top. If a change is significant, we will tell you in the app or by email at least 14 days before it takes effect, and the app may ask you to agree to the new terms before you continue.
